Terms of Service
Sign in, join the server, or subscribe, and these apply: what you can expect of us, and what we expect of you.

Who these terms apply to
Three kinds of people use the service, and the terms cover all of them:
- Players: they join the Westcountry or other depart.cloud multiplayer servers, and playing needs no website account.
- Crew members: they create a depart.cloud website account by signing in with Discord, to keep a duty record and use depart.HR.
- Supporters: they subscribe to the supporter tier.
You must be at least 13 to create an account or use the service. If you are under 18, you need a parent or guardian's permission before subscribing. Where local law in your country sets a higher minimum age for consent to data processing, that higher age applies.
Accounts
Accounts are created only by signing in with Discord. When you do, we receive your Discord email address, display name and avatar, as explained on the privacy policy. You are responsible for keeping your Discord account secure, because it controls your depart.cloud account.
One account per person. Don't share it, sign in as somebody else, or register new accounts to get around moderation. You may not sell, transfer or trade accounts, crew names or supporter benefits. We may suspend or terminate accounts that breach these terms or the server rules.
Crew names and public profiles
On joining the server your account is assigned a crew name (an "OMSI username"): your Discord display name plus a random tag, like Alex#4821. Supporters may change their crew name and may choose a public handle, which puts their duty record on a public page at an address they pick (depart.cloud/people/your-name).
Crew names, handles and profile customisations must not be offensive or impersonate anyone, and must not misrepresent affiliation with UKDT, M-R Software, depart.cloud or any other operator. We may change or reset a crew name that breaks this. The content you choose for your profile stays yours, but you give us a worldwide, royalty-free licence to display it as part of running the service, on public boards and profile pages, for as long as your account exists.
Acceptable use and the server rules
When using the multiplayer server you follow the rules published on the rules page, which form part of these terms.
You must not:
- cheat, exploit bugs, use automation or modified clients to gain an unfair advantage, or interfere with the server or other players;
- attack, disrupt or try to gain unauthorised access to any part of the service or its infrastructure;
- scrape or harvest data from the public boards and profiles, or republish it, beyond personal, non-commercial use;
- harass or abuse other players or crew members, in game or anywhere in the community;
- use the service for any unlawful purpose.
We may moderate, mute, kick or ban players, and limit or remove features, at our reasonable discretion where these terms or the server rules are breached.
Supporter subscriptions and payments
The supporter tier is a subscription, currently £4.99 a month, billed through Stripe. Prices may change, and we will give reasonable notice first; changes never apply to a period already paid for. Payment processing is handled by Stripe, and we never see or store your full card details.
Your supporter status and its expiry are managed by us from webhook messages sent by Stripe; your browser is never treated as proof of payment. If a discrepancy ever arises, our records, verified against Stripe, are authoritative.
You can cancel whenever you like, from the Stripe customer portal linked on the supporter page. Cancelling stops future renewals: you keep the benefits for the remainder of the period you have paid for, and afterwards your record and its history stay put, with only the badge and the extras going.
Because the service is digital and begins as soon as you subscribe, the usual 14-day withdrawal window does not apply once supply has started, except where law says otherwise. Refunds beyond that are at our discretion.
Availability and changes to the service
The service is available as is, and as available. We aim to keep the server and website up, but we don't guarantee uninterrupted or error-free operation. The server may go offline for maintenance, or be withdrawn, at any time.
We may add, change or remove features, maps, servers, limits and content policies. If a change is material and negative, we will give reasonable notice on the site before it takes effect.
Intellectual property
The depart.cloud name, design, website code and content are owned by us or licensed to us. All rights are reserved. Third-party property stays third-party: your use of OMSI 2, the Westcountry 3 map and openOMSI is governed by their own licences.
You keep ownership of content you choose for your profile (see crew names and public profiles). In-game activity you perform is recorded by the service as duty data, and is not claimable as your intellectual property.
Disclaimers and limitation of liability
To the fullest extent permitted by law, we exclude all implied warranties, conditions and terms relating to the service. We are not liable for loss of data, loss of profit, or indirect or consequential loss arising from your use of, or inability to use, the service, except where such an exclusion is not permitted by law.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. To the extent permitted by law, our total liability arising out of or in connection with the service is limited to the total you paid us in the 12 months before the event giving rise to the claim (or £30 where you made no payment).
Suspension and termination
You may stop using the service at any time, and you may ask for your account to be deleted (see the privacy policy for how that is handled).
We may suspend or terminate your account or access to the server, with or without notice, if you seriously or repeatedly breach these terms or the server rules, or if the law requires it. Where it is practical, we will tell you what action was taken and why.
Third-party services
The service integrates others: Discord for sign-in, Stripe for payments, and hosting providers for the servers. Their own terms and privacy policies also apply to your use of them, and we are not responsible for services outside our reasonable control.
Governing law
These terms are governed by the laws of Scotland, and the courts of Scotland have exclusive jurisdiction over any dispute, except that consumers keep any mandatory protections and local court jurisdiction granted to them by the law where they live. Nothing here affects your right to complain to a consumer protection body.
If any provision of these terms is found unenforceable, the rest stay in force.
Changes to these terms
We may update these terms from time to time, and the current version is always on this page. Where the change is material, we will give reasonable notice on the site before it takes effect. Continuing to use the service after changes take effect means you accept the updated terms.
